Greetings, we are Filmbot Inc (“Filmbot”), a provider of websites and point-of-sale ticketing software (our “Services”) for cinemas and film festivals. We collect information on behalf of our cinema and film festival partners. You should also read the cinemas’ and film festivals’ Privacy Policies to understand how they will use your information. At Filmbot (“Filmbot”, “we”, “us”, “our”), we care about the privacy of users of our Services, and the purpose of this Privacy Policy (this “Policy”) is to help them understand: (1) what types of personal information we may collect from users of these Services, (2) the purposes for which we use such information, (3) our disclosure policies, and (4) your rights regarding any personal information we collect. Purpose of the Privacy Policy.

 

Filmbot is committed to respecting and protecting your privacy rights, and we created this Privacy Policy to give you (the user) notice of how your private information will (and will not) be used by us in connection with our Services (together with its subdomains, content and services). In simplified form (greater detail is below), our policy can be summarized as follows:

 

  1. We take privacy seriously.
  2. We do not collect information from children under 13 years of age.
  3. We work with payment processor Stripe to help keep your payment transaction data secure. Please see their Privacy Policy here.
  4. We will not sell or rent your personal information, but may share it with our cinema and/or film festival merchants from which you have purchased tickets, as well as our third-party development partners when necessary for database and application testing and software improvements.
  5. We may aggregate customer information and purchasing behavior across cinemas and festivals.
  6. In certain legal situations, we may be compelled to disclose your information, but we will let you know if that occurs.
  7. If you are outside the United States, you understand and agree that we may store your information in the United States.
  8.   You are always welcome to contact Filmbot to better understand how we handle customer data.

 

This Privacy Policy applies to the online websites and box office stations where you visit and/or make purchases.

 

This policy describes how we treat specific types of personal and non-personally identifiable information through our Services where you visit and/or make purchases. By interacting with us, you consent to these practices.

This privacy policy applies to how we use your information.

 

We obtain and manage specific types of information from you.

 

  • During ONLINE website checkout transactions – including but not limited to tickets, donations and membership purchases – data entered by customers is handled as follows:

 

The following details are stored by Filmbot:

  •   Full name
  •   Email Address
  •   Last 4 digits of credit card
  •   Credit card brand
  •   Billing address (only for donations, memberships and film festivals)
  •   Billing postal code
  •   Country
  •   Birthday (only for memberships)
  •   Phone number (memberships and film festivals)
  •   Interests (only for memberships)

 

The following details are submitted directly to Stripe through a Stripe-hosted form, so are not stored or transmitted by Filmbot:

 

  •   Cardholder Data, including Primary Account Number (PAN)
  •   Sensitive Authentication Data (ie. CVV)

 

During an online transaction, Stripe returns the following data to Filmbot:

 

  •   Credit card last 4 digits
  •   Month and year expiration date
  •   Amount of purchase

 

 

During onsite transactions at the box office or kiosks, credit card data is transmitted directly through Stripe technologies and compatible hardware.

 

During an onsite transaction, Stripe returns the following data to Filmbot, which is stored by Filmbot:

 

  •   Authorized amount
  •   Cardholder name
  •   Card brand
  •   Last 4 digits of card
  •   Date and time of transaction
  •   Response from processor

 

An email address may be collected at the box office station during the transaction and will be stored with the customer profile.

 

For every online and onsite ticketing order, Filmbot generates an Order ID associated with that specific order.

 

Customer Profiles and Purchase History

Filmbot may construct customer profiles that track purchases of tickets, concessions, merchandise, memberships, donations, tickets and concessions discounted by memberships and/or promotional discounts, and purchase history across the Filmbot point-of-sale system and dining point-of-sale systems used by cinema and film festival merchants. This information may be shared with the cinemas from which you have purchased tickets so they may better understand their audience, market and offer incentives directly to their customers, and/or improve their service.

 

Promotional Emails

Cinemas and film festival merchants may use our Services to send you promotional emails based on your visit history, past ticket purchases, or other targeting segmentation for the purpose of attracting and/or incentivizing you to purchase more tickets and return more frequently. You have the option to opt out of these marketing emails by choosing the “unsubscribe” option in such emails and/or by directly notifying the cinema or film festival.

 

We use Google Analytics to better understand how visitors find and use our online cinema experience.

 

Cinema Newsletter

We enable you to opt into receiving email newsletters managed directly by the cinema, by entering the following information which we share with their third-party service Mailchimp:

  •   Full name
  •   Email address

We use information as disclosed and described here.

 

We use information to administer our Services.

 

We use information to send you email confirmation of your purchase of tickets, concessions, merchandise, memberships and/or donation orders when purchasing through our point-of-sale Services.

 

We use information to respond to your requests or questions. For example, we might use your information to respond to your customer feedback.

 

We use information to improve our products and services. We may use your information to make our Services and products better in collaboration with cinema merchants and our third-party partners.

 

We use information for security purposes. We may use information to protect our company, our merchant partners, and our websites.

We use information for marketing purposes. For example, our theater and/or festival merchants might send you promotional discount offers to incentivize you to purchase more tickets and return more frequently. These might be offers or products they think you might find interesting. You have the option to opt out of these marketing emails by choosing the “unsubscribe” option in such emails and/or by notifying the cinema or film festival.

 

We use information as otherwise permitted by law.

 

We may share information with third parties with whom we administer our Services.

 

We will share information with our cinema partners. Theater and festival management may use this information to better understand their audience and market to their customers.

 

We will share information with complimentary vendors. We may share select information, such as the specific reserved seats associated with a ticket order, with a third-party dining point-of-sale system in order to enable the customer to order their food and drinks ahead of a showtime and have it delivered to their seat at showtime.

 

We will share your information with the cinema’s payment processor Stripe (currently, https://stripe.com/). For information about how they may use and share your data, please visit https://stripe.com/privacy.

 

We will share information if we think we have to in order to comply with the law or to protect ourselves. For example, we will share information to respond to a court order or subpoena. We may share it if a government agency or investigatory body requests. We might share information when we are investigating potential fraud.

 

We may share information with any successor to all or part of our business. For example, if part of our business was sold, we may share information as part of that transaction.

 

We may share information for other reasons we may describe to you.

 

You have certain choices about sharing and marketing practices.

 

You can opt out of receiving marketing emails. To stop receiving promotional emails from a cinema or film festival, please email them directly. We will still send you transactional messages. These include responses to your questions.

 

You can control cookies and tracking tools. Your browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. To control flash cookies, which we may use on certain websites from time to time, you can go here. Why? Because flash cookies cannot be controlled through your browser settings.

 

Our Do Not Track Policy: Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals.  If you block cookies, certain features on our sites may not work.  If you block or reject cookies, not all of the tracking described here will stop.

 

Your California privacy rights.

If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

 

These sites and apps are not intended for children.

Our Platforms are meant for adults. We do not knowingly collect personally identifiable information from children under 13 without permission from a parent or guardian. If you are a parent or legal guardian and think your child under 13 has given us information, you can email us at contact@filmbot.com. You can also write to us at the address listed at the end of this policy. We store information in the United States.

Information we maintain may be stored both within and outside of the United States.  If you live outside of the United States, you understand and agree that we may transfer your information to the United States. This site is subject to U.S. laws, which may not afford the same level of protection as those in your country.

 

We use standard security measures.

The Internet and software apps are not 100% secure. We cannot promise that your use of our Services will be completely safe. We encourage you to use caution when using apps and the Internet. To learn more about how to protect yourself online, visit www.ftc.gov. We keep personal information as long as it is necessary or relevant for the practices described in this Policy. We also keep information as otherwise required by law.

 

We may link to other sites or have third party services we don’t control.

Our Services may have links to websites we do not control. Our Services may also have plugins or host other third party services that we don’t control. This policy does not apply to the privacy practices of those websites or third parties. When you interact with those websites or third parties, they may collect information from you.  Read the privacy policy of other websites carefully. We are not responsible for these third party practices.
